Terms of Service

1. Introduction

By purchasing from Indie Bundlr ('we,' 'us,' or 'our') or by registering an account, you agree to be bound by these Terms of Service ('Terms'). If you disagree with any part of these Terms, you may not use our services.

2. Definitions

  • 'Marketplace' refers to Indie Bundlr, its website, and all related services.
  • 'Seller' refers to any individual or entity offering products or services through the Marketplace.
  • 'Purchaser' refers to any individual or entity buying products or services through the Marketplace.
  • 'Bundle' refers to a collection of apps or services offered at a discounted price.
  • 'Coupon' refers to the digital code provided to Purchasers to gain access to purchased Bundles.

3. Marketplace Services

3.1. The Marketplace provides a platform for Sellers to offer their apps and services, individually or in Bundles, to Purchasers at discounted prices.

3.2. The Marketplace facilitates transactions between Sellers and Purchasers but is not a party to any transaction between Sellers and Purchasers.

3.3. The Marketplace does not guarantee the quality, safety, or legality of items offered, the truth or accuracy of Sellers' listings, the ability of Sellers to sell items, or the ability of Purchasers to pay for items.

4. User Responsibilities

4.1. Purchaser Responsibilities:

  • Purchasers are solely responsible for verifying the legitimacy and suitability of any product or Bundle before purchase.
  • Purchasers acknowledge that the Marketplace cannot guarantee the quality, safety, or legality of items offered.
  • Purchasers agree to use the provided Coupons in accordance with the terms set by the Sellers.
  • Purchasers are responsible for ensuring they understand what they are buying and that their purchase is not a scam or impersonation.

4.2. Seller Responsibilities:

  • Sellers must provide accurate and complete information about their products and services.
  • Sellers are responsible for fulfilling all purchases and providing customer support for their products.
  • Sellers must comply with all applicable laws and regulations.
  • Sellers are responsible for setting their own prices and determining the terms of their offers.

5. Prohibited Activities

Users may not:

  • Impersonate other individuals or entities.
  • Engage in fraudulent activities or misrepresent products or services.
  • Attempt to manipulate the Marketplace's systems or processes.
  • Violate any applicable laws or regulations.
  • Use the Marketplace for any illegal purposes.
  • Interfere with other users' listings.
  • Post false, inaccurate, misleading, defamatory, or libelous content.

6. Intellectual Property

6.1. All content on the Marketplace, unless otherwise specified, is the property of Your Marketplace or its licensors and is protected by copyright, trademark, and other intellectual property laws.

6.2. Sellers retain ownership of their intellectual property rights in their products and services.

6.3. By listing items on the Marketplace, Sellers grant us a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sublicensable right to exercise any and all intellectual property rights in that content in connection with our provision of the Marketplace.

7. Dispute Resolution

7.1. Purchasers must attempt to resolve any issues directly with the Seller through the appropriate channels provided for the affected app.

7.2. Purchasers must wait 48 hours before contacting the Marketplace regarding unresolved issues.

7.3. To report an issue, Purchasers must contact the Marketplace via email at support@yourmarketplace.com and provide sufficient proof of their claim.

7.4. The Marketplace will contact the Seller, who is expected to resolve the issue within 72 hours of being notified.

7.5. Failure to resolve issues may result in Seller strikes, as outlined in Section 8.

8. Seller Strike System

8.1. Sellers who fail to resolve Purchaser issues within 72 hours of being notified by the Marketplace will receive a strike.

8.2. Consequences of strikes:

  • First Strike: The item is refunded. The platform fee increases from 15% to 25%, and the payment cooldown period increases from 7 to 14 days, indefinitely.
  • Second Strike: The Seller's account is flagged publicly. The platform fee increases to 50%, and the payment cooldown period increases to 21 days, indefinitely.
  • Third Strike: The Seller is permanently banned. Any new or associated accounts will also be banned. All Seller products are removed from the Marketplace.

9. Limitation of Liability

9.1. The Marketplace is not responsible for:

  • The quality, safety, legality, or any other aspect of the items or services offered on the platform.
  • Any direct, indirect, incidental, special, or consequential damages arising from the use of the Marketplace or any products or services purchased through the Marketplace.

9.2. The Marketplace's total liability for any claim arising from or relating to these Terms or the use of the Marketplace shall not exceed the amount paid by the user to the Marketplace in the six months preceding the claim.

10. Indemnification

Users agree to indemnify, defend, and hold harmless Your Marketplace, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses arising from or relating to their use of the Marketplace.

11. Modifications to Terms

Your Marketplace reserves the right to modify these Terms at any time. Users will be notified of significant changes. Continued use of the Marketplace after changes constitutes acceptance of the modified Terms.

12. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of [Your Jurisdiction]. Any disputes arising from these Terms or the use of the Marketplace shall be subject to the exclusive jurisdiction of the courts in [Your Jurisdiction].

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect and enforceable.
